BY USING CREDIT 1 USA’S WEBSITE, ENGAGING CREDIT 1 USA’S SERVICES, REQUESTING THAT CREDIT 1 USA CONTACT YOU ABOUT ITS CREDIT REPAIR SERVICES, AND/OR PARTICIPATING IN CREDIT 1 USA’S TEXT MESSAGE PROGRAM,YOU AGREE TO ARBITRATE ALL CLAIMS BETWEEN YOU AND CREDIT 1 USA ON AN INDIVIDUAL BASIS ONLY AND NOT AS A PART OF ANY CLASS. A “CLAIM” IS ANY CASE, CONTROVERSY, DISPUTE, TORT, DISAGREEMENT, LAWSUIT, LEGAL ACTION, OR CLAIM NOW OR HEREAFTER PENDING BETWEEN YOU AND CREDIT 1 USA, INCLUDING BUT NOT LIMITED TO ANY ALLEGED STATE OF FEDERAL STATUTORY VIOLATION, OR ANY DISPUTE OVER THE INTERPRETATION OF THE WEBSITE TERMS OR THE ARBITRABILITY OF ANY CLAIM PURSUANT TO THE WEBSITE TERMS. THIS AGREEMENT TO ARBITRATE GOVERNS ALL PAST, CURRENT AND PROSPECTIVE INTERACTIONS WITH CREDIT 1 USA. YOU AGREE THAT YOU ARE WAIVING ALL RIGHTS TO: (A) A TRIAL BY JURY; (B) PARTICIPATE IN A CLASS ACTION LAW SUIT OR CLASS ACTION ARBITRATION; AND (C) BRING AN ACTION AGAINST CREDIT 1 USA IN A COURT OF LAW. YOU MAY INDIVIDUALLY ARBITRATE ANY CLAIM AGAINST CREDIT 1 USA IN ANY JURISDICTION IN THE UNITED STATES. CREDIT 1 USA WILL REIMBURSE YOU UP TO $350 OF YOUR ARBITRATION FILING FEE. THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION THEN IN FORCE SHALL GOVERN THE ARBITRATION (provided, however, that the terms of the Website Terms shall control over any inconsistency between the Rules of the American Arbitration Association and the Website Terms). The arbitrator shall have authority to interpret the Website Terms, including but not limited to the authority to decide whether any claim is arbitrable under the Website Terms and to decide issues related to the scope of arbitration, the rules of arbitration, the arbitrator’s jurisdiction, and the enforceability of the Website Terms. You agree that the Website Terms involves commerce under 9 U.S.C. §§ 1 et seq. and that this Arbitration Clause is governed by federal law, including the Federal Arbitration Act. - Signing Up for Credit 1 USA’s Services
You are not required to sign up for Credit 1 USA’s services in order to visit and read material on the Website; however, you will need to sign up if you want it to assist you in your efforts to improve your credit reports and rating. If you do so, you agree to provide accurate and complete information. You must be legally capable to enter into contracts. It is your responsibility to make any updates to that information. Each sign-up is for a single person only. We do not permit any other person to enroll in Credit 1 USA’s services on behalf of another unless you have an appropriate Power of Attorney. You are responsible for preventing such unauthorized use. If you believe there has been unauthorized use, you should notify Credit 1 USA immediately by emailing firstname.lastname@example.org.
Client Agreement for Payment of Fees/Default
- You authorize Credit 1 USA to make recurring charges to your Credit/Debit Card for Credit Repair Service.
- You hereby agree to be charged a late fee of $15 for any invoice that the $89.00 minimum monthly payment is not paid by the due date.
- You understand that this authorization will remain in effect until you cancel it in writing, and you agree to notify Credit 1 USA in writing of any changes in your account information or termination of this authorization at least seven (7) days written notice, or through your customer portal prior to the next billing date.
- You certify that you are an authorized user of this credit/debit card and will not dispute these scheduled transactions with your bank or credit card company; so long as the transactions correspond to the terms indicated in this agreement.
- You will be charged $38 for checks returned for Non-sufficient Funds (NSF). You understand and agree that in a case of NSF. You will have 10 days to satisfy the debt and bring the account to a current status.
- In the event of Non-sufficient Funds. Credit 1 USA will suspend all services until the account is brought to a positive status. If the account is not brought to a current status within 10 days, Credit 1 USA will consider your account in default of contract, and Credit 1 USA will demand full payment of any and all balances.You understand and agree that payment arrangements made on any balance owed to Credit 1 USA is at the sole discretion of Credit 1 USA.
- You understand and agree that your account is subject to default after 60 days of non-payment.
- You understand that upon default of your account with Credit 1 USA, all judgments to collect funding shall bear interest at the rate of 12 percent per annum which will bear interest from the day of the cause of action, attorney fees of $150.00 per hour, plus costs of collection.
- You understand that Credit 1 USA, will give you a refund only if services were not actually performed by Credit 1 USA. Any other refunds will be at the sole discretion of Credit 1 USA.
The Website contains information, content or advertisements text, photographs, designs, graphics, images, sound and video recordings, animation and other materials and effects (collectively, the “Content”) that are protected by copyrights, trademarks, service marks, trade dress, patents or other intellectual or proprietary rights owned by Credit 1 USA or other third parties. All trademarks and copyrighted information contained on the Website are the property of their respective owners. Further, Credit 1 USA retains all rights (including intellectual property rights), title and interest in the Website, technology, and all underlying technology and data including any enhancements, software, applications and improvements related to the Website (the “Technology”)(the terms Content and Technology collectively will be referred to as the “Materials”). You may not remove from any electronic or printed copy any copyright, trademark, or other proprietary notice.
